Terms of Use

These Terms of Use (“Terms”) govern your access to and use of elderlivingguide.com and related pages (the “Site”). Effective date: September 17, 2026.

By using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.

1. Nature of the service

Elder Living Guide provides general educational content about in-home care, assisted living, memory care, and related family decisions, and may match visitors who request help with independent care providers, communities, or partner companies. The Site is a lead-generation and information resource—not a residential care facility, staffing agency, hospital, or clinical practice.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site or submit a request. You represent that information you provide is accurate to the best of your knowledge and that you are authorized to share contact details for the inquiry.

3. Not medical advice; not a care provider

Elder Living Guide does not provide medical advice, nursing care, diagnosis, treatment, or emergency services. Content on the Site is for general informational purposes only. It is not a substitute for advice from a physician, nurse, geriatric care manager, attorney, or other licensed professional. No provider–patient or caregiver–client relationship is created by browsing, submitting a form, or speaking with someone after a referral. Always verify licenses, staffing, costs, contracts, and clinical suitability directly with any community or agency. We do not guarantee placement, availability, pricing, quality of care, or any particular outcome.

If someone is in immediate danger or needs urgent medical help, call 911 (or your local emergency number)—do not use this Site for emergencies.

4. Lead matching and partner contact

When you submit a form, you ask us to review your inquiry and, where appropriate, share your information with one or more independent partners who may offer related senior-care services. Those partners may contact you by phone, text, or email as described in the consent language on the form and in our Privacy Policy. Partners are separate businesses; we do not control their advice, fees, admissions decisions, or quality of care. Any engagement you enter with a partner is solely between you and that partner.

Providing consent to be contacted is voluntary and is not a condition of purchasing any property, goods, or services from us (the Site’s educational content remains available without purchasing anything from us).

5. Your submissions

You retain ownership of content you submit, but you grant us a non-exclusive, worldwide, royalty-free license to use, store, reproduce, and share that content as needed to operate the Site, match leads, communicate with you, and comply with law—consistent with our Privacy Policy. Do not submit medical records, Social Security numbers, Medicare/Medicaid numbers, full financial account numbers, or other highly sensitive data through Site forms.

6. Acceptable use

You agree not to:

Use the Site for unlawful purposes or to harass, defraud, or harm others;
Scrape, harvest, or bulk-export Site content or lead forms without our written permission;
Interfere with Site security, introduce malware, or attempt unauthorized access;
Impersonate any person or misrepresent your affiliation or authority to request care information;
Submit false contact information to generate spam or fraudulent leads.

7. Intellectual property

The Site’s text, design, logos, and graphics are owned by us or our licensors and are protected by intellectual property laws. You may view and temporarily download pages for personal, non-commercial use. You may not copy, modify, or redistribute Site materials for commercial use without prior written consent.

8. Third-party sites and partners

The Site may link to third-party websites or refer you to partners. We are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

9. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT CONTENT IS COMPLETE, CURRENT, OR SUITABLE FOR YOUR FAMILY’S CARE NEEDS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAM LEPORE AND ELDER LIVING GUIDE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR FROM ANY REFERRAL OR PARTNER INTERACTION—INCLUDING ANY CARE DECISIONS YOU OR YOUR FAMILY MAKE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.

11. Indemnity

You agree to defend, indemnify, and hold harmless Sam Lepore and Elder Living Guide from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site, your submissions, or your violation of these Terms or applicable law.

12. Changes; termination

We may update these Terms by posting a revised version with a new effective date. Continued use after changes constitutes acceptance. We may suspend or stop offering the Site, or restrict access, at any time.

13. General

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms are governed by applicable United States federal law and the laws of the state in which the operator resides, without regard to conflict-of-law principles, except where mandatory consumer protections of your state of residence apply. Courts located in that same state may hear disputes, subject to those mandatory protections. You may have additional rights that cannot be waived by contract.
